Assess the circumstances before agreeing the exit
The legal consequences of ending employment depend on the applicable regime, the reason for termination, the contractual terms and the procedure followed. Resignation, termination with notice, dismissal without notice and a negotiated departure raise different questions.
A disputed dismissal is not automatically unlawful. Under the federal private-sector framework, termination connected with a serious complaint to the Ministry of Human Resources and Emiratisation or a lawsuit whose validity is established raises a specific statutory protection. Other alleged breaches require their own analysis.
How the firm can assist
Hyam El Hachem Law Firm can examine the proposed or completed termination, review the financial entitlements and advise on a carefully documented settlement or dispute strategy. Early review is particularly useful before signing an acknowledgement, release or restrictive undertaking.
- Termination grounds, notice provisions and the supporting chronology.
- Final remuneration, end-of-service arrangements and disputed settlement calculations.
- Confidentiality, restrictive covenants, releases and the practical steps required to conclude the relationship.
- Contract, applicable workplace policies and termination or resignation correspondence.
- Relevant performance records, complaints and the sequence of events.
- Proposed settlement, final calculations and any restrictive undertaking.
An initial outline is enough. Detailed records can follow through a process agreed with the firm.
Questions clients often ask
Should a settlement be reviewed before it is signed?
A review can clarify the amounts payable, obligations that continue after employment and the intended effect of any release. The wording, evidence of payment and applicable mandatory protections should be considered together.
Is unemployment insurance the same as end-of-service compensation?
No. The Involuntary Loss of Employment insurance scheme is a separate arrangement with its own eligibility and claim conditions. A potential insurance benefit does not replace the analysis of wages, notice or other employer obligations.
